Volunteer Terms & Conditions

I understand that For Goodness Cakes is a volunteer-based nonprofit that strives to give underprivileged youth, be it at-risk youth, foster children, or the children of low-income families, a chance to celebrate their birthday through the volunteer effort of donating homemade birthday cakes.

Agreement to Terms and Conditions As a volunteer for For Goodness Cakes, I hereby agree to these Volunteer Terms and Conditions (the “Volunteer Terms”). I hereby declare and represent that I am of legal age and am competent to sign these Volunteer Terms. I understand and agree that I will be held as legally bound, obligated, or responsible for any electronically signed submission I make as I would be by making such submission in hardcopy form with my handwritten signature.

Driver’s License and Auto Insurance I hereby confirm that I have an active and current driver's license and auto insurance in the state I'm volunteering in, covering the vehicle(s) I plan to use during such times as I conduct any volunteer activities on behalf of For Goodness Cakes where I will be driving, such as delivery of baked donations. At all times during which I act as a volunteer for For Goodness Cakes, I agree to continue to maintain a valid driver’s license and a current automobile policy (in coverages sufficient to meet the current lawful minimum insurance coverage) for any vehicle(s) I will use/operate as a volunteer. Upon request of For Goodness Cakes, I will provide For Goodness Cakes with a copy of my driver’s license, DMV driving record report, or automobile insurance policy.

Waiver of Liability; Indemnification I ASSUME FULL RESPONSIBILITY AND ALL LIABILITY FOR MY ACTIONS IN CONNECTION WITH MY SERVICES AS A VOLUNTEER FOR FOR GOODNESS CAKES, INCLUDING, WITHOUT LIMITATION, RESPONSIBILITY AND LIABILITY FOR ANY RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE ARISING OUT OF OR RELATED TO MY SERVICES AS A VOLUNTEER FOR FOR GOODNESS CAKES, WHETHER CAUSED BY THE NEGLIGENCE OF FOR GOODNESS CAKES, ANY ACT OR OMISSION OF FOR GOODNESS CAKES, OR OTHERWISE.

I agree to hold harmless For Goodness Cakes, its officers, directors, affiliates, employees and agents against any and all loss, damages, liabilities, settlement, costs and expenses (including legal expenses and the expenses of other professionals) as incurred, resulting from or arising out of my services as a volunteer for For Goodness Cakes.

Instructions; Confidentiality I acknowledge and agree to follow the baking, food handling safety and delivery instructions provided to me by For Goodness Cakes. I agree to keep the information I receive regarding the agencies and children to whom For Goodness Cakes serves confidential. I will not share such information with any third party without the prior consent of an officer or director of For Goodness Cakes.

Privacy For Goodness Cakes only collects and stores the personal information that you provide to For Goodness Cakes in connection with your services as a volunteer. For Goodness Cakes utilizes a cloud-based data storage system, which is hosted in a secure environment. For Goodness Cakes limits access to its data storage system to members of its operations team, officers and directors. Your personal information is used solely to facilitate For Goodness Cakes operations and services and for no other purposes. For Goodness Cakes does not and will not sell your personal information to any third party. Necessary information will be disclosed to the police and other law enforcement agencies; security forces; competent governmental and regulatory authorities when legally obligated to do so. Your personal information will be stored in For Goodness Cakes’ data storage system as long as you provide services as a volunteer for For Goodness Cakes and for two years thereafter.

Communication For Goodness Cakes will communicate with all volunteers via the email address and telephone numbers provided on the volunteer information sheet at time of sign-up, in relation to the activities of For Goodness Cakes. It is the responsibility of each volunteer to notify For Goodness Cakes to any changes in contact details necessary to facilitate the continuation of voluntary services. On signature of these Terms and Conditions, I understand that I will be added into the For Goodness Cakes communication email database, allowing regular communication in relation to For Goodness Cakes activities; including but not limited to the baking opportunities sign-up sheet, newsletters and invites to events. Volunteers can ‘opt-out’ of the newsletters and communication email at any time by emailing info@forgoodnesscakes.org.

Photos I grant to For Goodness Cakes, its representatives, agents and employees the right to take photographs of me and my baked goods in connection with my services as a volunteer for For Goodness Cakes. I authorize For Goodness Cakes, its assigns and transferees to copyright, use and publish the photographs taken by For Goodness Cakes or provided by me to For Goodness Cakes in print and/or electronically. I agree that For Goodness Cakes may use such photographs of me with or without my name and for any lawful purpose, including for example such purposes as publicity, illustration, advertising, and web content.

Social Media For Goodness Cakes embraces social media and love to see people sharing our photos and what we do for children. However, it is important to respect the privacy and confidentiality of the children and agencies we serve. Accordingly, I agree that I (a) will not post pictures of children or pictures that include any images which may identify a child or an agency, (b) will not include the name or age, or any other identifying information of a child, or the name of any affiliated agency in any post (with the exception of the first name only that may be displayed on the cake itself), and (c) will tag (as instructed by For Goodness Cakes) all appropriate links to For Goodness Cakes when possible.

Background Checks As a volunteer for For Goodness Cakes, I hereby agree and understand that For Goodness Cakes may desire to conduct a background check on its volunteers. Upon request of For Goodness Cakes, I agree to cooperate with any background check, including completing all information and authorizations necessary to conduct such background check. If I do not cooperate with such background check, or do not wish for For Goodness Cakes to conduct such background check, I understand that my status as a volunteer with For Goodness Cakes may be terminated.

Termination of Volunteer Relationship Either party may terminate the volunteer relationship at any time, with or without cause, by notifying the other party. For Goodness Cakes will notify you if it has terminated your status as a volunteer by sending you notice of such termination at the email address it has on record for you. You may terminate your status as a volunteer by providing notice of such termination to For Goodness Cakes by sending an email, clearly indicating your intent to terminate your volunteer relationship, to info@forgoodnesscakes.org.

Changes to Volunteer Terms and Conditions For Goodness Cakes may need to update these Volunteer Terms from time to time. If so, For Goodness Cakes will post the updated Volunteer Terms on our website located at www.forgoodnesscakes.org, along with a notice that the Volunteer Terms have been changed so you are always aware of the terms of your services as a volunteer for For Goodness Cakes. For Goodness Cakes may also send volunteers an email notification of material changes to the Volunteer Terms. For Goodness Cakes encourages you to review these Volunteer Terms regularly for any changes. If you disagree with the Volunteer Terms, you may terminate your relationship with For Goodness Cakes by following the procedures set forth above. Your continued services as a volunteer for For Goodness Cakes will be subject to the terms of the then-current Volunteer Terms.

Electronic Signatures These Volunteer Terms may be executed and delivered by any electronic transmission device pursuant to which the signature of or on behalf of such party can be seen (including pdf or any electronic signature complying with the U.S. federal ESIGN Act of 2000). Such execution and delivery shall be considered valid, binding and effective for all purposes.
